Terms of Service
These Terms govern your use of the OpsJolt website and your initial interactions with OpsJolt regarding automation, AI, integration, and workflow services.
← Back to OpsJolt1. Acceptance of these Terms
By accessing or using opsjolt.com, you agree to these Terms of Service. If you do not agree, please do not use the website.
2. Website information and OpsJolt services
The website describes automation capabilities, examples, integrations, and potential service offerings. Website content is provided for general information and does not by itself create a client relationship, guarantee availability, or constitute a binding project commitment.
A project begins only when scope, deliverables, commercial terms, responsibilities, and any other required conditions are agreed in writing.
3. Proposals, pricing, and payment
Any estimate, proposal, timeline, or recommendation provided before a written agreement is subject to change based on discovery, technical constraints, third-party requirements, requested revisions, or changes in scope. Payment terms, taxes, expenses, cancellations, and refunds for paid projects will be defined in the relevant proposal or service agreement.
4. Client responsibilities
Clients are responsible for providing accurate requirements, timely feedback, appropriate access to systems and accounts, necessary permissions, lawful data, and authorized credentials or API access. Clients remain responsible for reviewing outputs and decisions where human review is appropriate.
5. Third-party platforms, APIs, and AI services
OpsJolt solutions may connect with services such as n8n, Make, OpenAI, CRMs, email providers, messaging platforms, calendars, databases, and other third-party products. Those services are governed by their own terms, pricing, availability, security practices, rate limits, and policies.
OpsJolt is not responsible for outages, policy changes, pricing changes, API changes, model behavior, account suspensions, or other actions controlled by third-party providers.
6. Intellectual property
The OpsJolt name, branding, website design, original website copy, and other OpsJolt-owned materials are protected by applicable intellectual-property laws. You may not copy, republish, sell, or represent OpsJolt materials as your own without permission.
Ownership and licensing of client-specific workflows, code, documentation, templates, or other deliverables will be determined by the applicable project agreement.
7. Acceptable use
You may not use the website or OpsJolt services to violate law, infringe rights, distribute malware, gain unauthorized access, conduct deceptive or abusive activity, interfere with systems, or automate activities that you are not authorized to perform.
8. Disclaimers
The website and its content are provided on an "as available" basis. Automation and AI systems can produce errors, depend on third-party services, and require monitoring and appropriate human oversight. Unless expressly stated in a signed agreement, OpsJolt does not guarantee uninterrupted operation, specific revenue outcomes, rankings, lead volumes, accuracy of third-party data, or that every process can be fully automated.
9. Limitation of liability
To the maximum extent permitted by applicable law, OpsJolt will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or reliance on its content. Liability for a paid client project, if any, will be subject to the limitations agreed in the applicable project agreement and applicable law.
10. Indemnity
To the extent permitted by law, you agree to be responsible for claims, losses, or costs resulting from your unlawful use of the website, misuse of services, infringement of third-party rights, or data and instructions you provide without proper authorization.
11. Suspension or termination
We may restrict access to the website or decline an inquiry or project where necessary for security, legal, operational, reputational, or policy reasons. Project termination rights, if applicable, will be described in the relevant service agreement.
12. Applicable law and disputes
These Terms are subject to applicable law. For client projects, any governing-law, venue, arbitration, or dispute-resolution provisions stated in the applicable signed agreement will control.
13. Changes to these Terms
We may update these Terms when our services, technology, or legal requirements change. The "Last updated" date above shows the most recent revision.
